The permit also covers concrete batch operations and hot mix asphalt operations.
The Explosives and Aggregate Division (EAD) is responsible for the implementation and enforcement of regulations governing aggregate reclamation and blasting under the Surface-Mined Land Conservation and Reclamation Act, coal blasting under the Surface Coal Mining Land Reclamation Act of 1980 and explosive storage and handling under the Illinois Explosives Act.
Surface Mine Reclamation staff work closely with stakeholders to ensure they are compliant with the Surface Mining Act. Inspections of known mines are performed every one to two years. Inspectors document the progress of mining and reclamation making sure it is consistent with their permit.
Sand and gravel pits are regulated from a safety aspect by the Texas Department of Transportation (TXDOT). Mining and reclamation of these pits are not regulated under State law. If the sand or gravel operations will affect ground water, have a surface-water discharge or create a point-source air discharge, the operation may be regulated by the Texas Commission on Environmental Quality (TCEQ).
